What Silvertree I's governing documents say
Silvertree I is a standard single-family home subdivision in Phoenix, AZ, governed by a homeowners association (HOA). All owners of Lots 1–128 and Tracts A–O are automatically members. The rules are designed to protect property values and apply to everyone who owns a home here.
- Single-family residential use only: All lots must be used exclusively for single-family residential purposes. No businesses, trades, or nonresidential uses are allowed. Minimum floor area of the dwelling is 1,200 square feet (excluding open porches, carports, and garages). Only one private garage for up to two cars is permitted per lot.
- Animals & pets: Only a 'reasonable number' of generally recognized house or yard pets are allowed; poultry and livestock are prohibited. Animals must be kept as domestic pets only, not for commercial purposes. The Board of Directors decides whether a pet is reasonable or a nuisance, and its decision is final.
- Leasing & rentals: An owner may lease their entire lot (with all improvements) to a single family, but no room rentals or transient tenants are allowed. The owner must provide a copy of the lease to the Board of Directors. Occupancy is limited to the lessee, their family, servants, and guests.
- Parking & vehicles: No boats, RVs, campers, trailers, trucks, or mobile homes may be kept or parked on any lot if visible from neighboring property, unless approved by the Board. Only automobiles in operating condition may be parked in streets, front yards, or carports. Garages must be used for parking and storage only, not for living or recreation.
- Architectural review & exterior changes: No building, fence, wall, or other structure may be erected or altered without prior written approval from the Board or an architectural committee. Plans must be submitted showing nature, kind, shape, height, materials, and location. If no response is given within 30 days, approval is deemed granted.
- Assessments & fees: The HOA levies annual and special assessments. Annual assessments start at a maximum of $50 per lot and may increase by up to 5% or the CPI increase each year without a vote. Larger increases or special assessments require approval by two‑thirds of each class of members. Assessments are uniform per lot and become a lien if unpaid.
- Maintenance obligations: Owners must maintain their lot and all improvements in good repair and adequately painted. Landscaping (front yards and areas visible from neighboring property) must be kept trimmed, cultivated, and free of weeds. If an owner fails to maintain, the HOA may step in after notice and charge the cost back as an assessment.
- Nuisances & noise: No nuisance activities are allowed—including offensive odors, excessive noise, unsightly conditions, or anything that disturbs neighbors. No exterior speakers, horns, or bells (except security devices) are permitted. Motorcycles and motor vehicles (except lawn equipment) may not be operated on walkways or sidewalks.
