What Ko Ko Palhs's governing documents say
This is an amendment to the original Declaration of Covenants, Conditions and Restrictions for Ko Ko Palhs, a condominium (horizontal regime) community in Phoenix, AZ. It modifies specific pages of the original CC&Rs but does not replace them. The document binds unit owners (apartment unit owners) and the association.
- Approval of alterations to units: No alterations to the apartment unit building may be made without written approval of all other unit owners and the Board of Directors. Plans prepared by a licensed architect must be filed with the association before work begins.
- Common elements maintenance & alteration: The association is responsible for maintenance and operation of common elements. Alterations or improvements to common elements require written approval of all unit owners, unless 20 or more owners approve and non-approving owners are relieved from the cost. All owners retain a one-twentieth (1/20th) interest in altered common elements regardless of contribution.
- Voting rights: There are two classes of membership: Class A (all owners except the developer) and Class B (the developer). Class A members may vote only after the 'Transfer of Control Date', then one vote per unit. Class B members have one vote per unit owned by the developer, including units held in trust for the developer.
