What Loma Verde's governing documents say
Loma Verde is a Phoenix, AZ residential community of individually owned lots with party walls between adjoining homes (townhome-style). The Loma Verde Homeowners Association enforces the rules and maintains common areas. This document is the full set of covenants, conditions, and restrictions (CC&Rs) binding all owners.
- Residential use: All lots are limited to single-family residential use only. No commercial or business activity is allowed on any lot, though owners may lease their lot to a single-family tenant subject to the rules.
- Architectural review: Any exterior improvement, alteration, landscaping, fence, wall, or change visible from neighboring property requires prior written approval from the Architectural Committee. This includes satellite dishes (under 39 inches allowed with placement approval), antennas, and roof-mounted equipment. A processing fee may be charged.
- Assessments & fees: Owners pay annual, supplemental, and special assessments. The board may increase annual assessments up to 10% or the CPI change (whichever is greater) without owner vote; larger increases require a two-thirds vote. A working capital fund equal to one-sixth of the annual assessment is due from each new owner (except builders and declarant). A transfer fee set by the board is also due on resale. Late payments incur a monthly late charge and may lead to a lien.
- Animals: Only a reasonable number of common household pets are allowed. No commercial breeding, nuisances, or structures visible from neighboring property. The board decides what is reasonable and whether an animal is a nuisance.
- Vehicles & parking: No vehicles over 3/4-ton (except pickup trucks with camper shells under 7 ft high), RVs, boats, or trailers may be parked visibly from neighboring property. Overnight street parking is prohibited. Inoperable vehicles must not be visible. Vehicles must be kept in garages, carports, or driveways.
- Leasing & rentals: Owners may lease their lot to a single family, but must promptly notify the association of the lease term and tenant's name. No minimum lease length is stated, but all other rules apply to tenants.
- Maintenance responsibilities: The association maintains common areas and may maintain landscaping and improvements in certain areas if the board agrees. Each owner is responsible for maintaining their own lot and improvements, including lawns, plantings, and building repair. If an owner fails to maintain, the association may step in and charge the owner.
- Party walls: Adjoining owners share the cost of party wall repair and maintenance proportionally to use. If damaged by something other than an owner's act, both share equally. Any modification requires written consent from the adjoining owner and the Architectural Committee.
