This is the full governing document for Lorna Park View Estates, a condominium community in Phoenix, AZ. You own your individual unit and an undivided interest in the common areas, which the association maintains and insures. The document binds all unit owners and their tenants, and outlines fees, use rules, and architectural controls.
- What you own & maintain: You own the interior of your unit, including windows, doors, electrical outlets, and HVAC (but not structural elements). The association maintains common areas (landscaping, perimeter walls, roofs, paved surfaces, and exterior features). You must keep your unit in good repair and are responsible for roof, HVAC, and glass surfaces.
- Leasing & rentals: Leases must be for at least 30 days (no transient/hotel use). Leases must be in writing and subject to the declaration. Owners must provide a copy of the proposed lease to the association within 7 days before signing. Short-term rentals under 30 days are prohibited.
- Use restrictions: Units are for single-family residential use only. No business or commercial activity is allowed (except model homes/sales office by the developer). No noxious activities, nuisances, or anything that increases insurance premiums.
- Pets: Usual household pets (dogs, cats, birds) are allowed subject to association rules. The board may require removal if a pet becomes objectionable. No breeding or raising of animals.
- Parking & vehicles: No trailers, campers, mobile homes, commercial vehicles (except standard pickup trucks), inoperable cars, boats, or off-road vehicles may be parked on the property except temporarily or inside an enclosed garage. Commercial markings on vehicles must be unobtrusive.
- Architectural review: No exterior alterations or improvements (including landscaping visible from other units or common areas) may be made without prior written approval from the Architectural Control Committee. Plans must be submitted; if not approved or disapproved within 45 days, approval is deemed given.
- Assessments & fees: Annual assessments are set by the board, initially capped at $780 per unit, and may increase by no more than 120% of CPI (or decrease by more than 20%) without a 75% vote. Assessments are due monthly or annually at the owner's option. Unpaid assessments incur 12% interest and become a lien on the unit. Special assessments require 75% member vote.
- Signs & window coverings: No signs advertising units for sale or rent except during open houses. No exterior clotheslines. Temporary window coverings must be removed within 90 days of purchase; foil or darkening screens are prohibited.
