Los Blancos Condominiums is a 48-unit condominium community in Phoenix, AZ. You own your individual unit plus an undivided share of the common elements (buildings, grounds, pool, parking, storage), which the association maintains and insures. The association funds common expenses through assessments paid by unit owners.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings) and are responsible for its maintenance, decorating, and repairs, including the portion of HVAC and utilities serving only your unit. The association maintains the common elements—roofs, structural components, common areas, and shared systems.
- Assessments & fees: Common expenses are allocated based on each unit's percentage interest in the common elements (2/122 for one-bedroom units, 3/122 for two-bedroom units). During the developer's control period, owner assessments were capped at $100/month for one-bedroom and $150/month for two-bedroom units, subject to change after transition.
- Leasing & rentals: The association has a right of first refusal on any sale or lease of a unit. An owner must give at least 30 days' written notice of a proposed sale or lease, including the proposed terms and buyer/lessee information. The association may purchase or lease the unit on those terms.
- Alterations & improvements: Non-structural interior alterations do not require board approval. Structural changes to a building, or any changes to common elements, patios, or balconies, require prior written board approval (and a majority owner vote for structural alterations to a building).
- Insurance: The association carries casualty insurance (fire, extended coverage) on the full replacement cost of the property, liability insurance (at least $1M per occurrence), and workers' compensation. Each owner may obtain additional insurance for furnishings and personal liability, but must avoid impairing the association's policies.
- Maintenance obligations: Owners must keep their unit, patio, and balcony in neat condition. If an owner's act (or that of a guest or pet) damages common elements or another unit, the owner pays for repair. The association has a right of access to units for maintenance of common elements.
- Right of first refusal: When an owner (other than the developer) wants to sell or lease their unit, they must first offer it to the association. The association has 30 days to decide whether to purchase or lease on the same terms. If it declines or fails to respond, the owner may close the deal within 90 days on terms no more favorable than those disclosed.
