Los Viveros is a 14-unit condominium (horizontal property regime) community in Phoenix, AZ. Unit owners own their individual apartment (including garage and private courtyard) and share undivided interests in the general common elements, which the association maintains. The declaration establishes single-family residential use, owner and association maintenance duties, and a system of assessments to fund common expenses.
- What you own & maintain: You own your apartment (dwelling, garage, private courtyard) as a freehold estate, plus a 7.14285% undivided interest in the general common elements. You must maintain interior surfaces, appliances, and the courtyard; the association maintains roofs, foundations, bearing walls, common landscaping, and all utility lines except their outlets inside your unit.
- Permitted uses & occupancy: Apartments must be used as single-family residences only. 'Single family' means persons related by blood, marriage, or adoption, or a group of up to three unrelated persons, plus domestic servants. No business, profession, or trade is allowed, but leasing to a single family is permitted.
- Pets: Up to two dogs, two cats, and two indoor caged birds per apartment are allowed as domestic pets, but only if they do not create a nuisance or unreasonable noise. No outdoor structures for animals are permitted that are visible from neighboring property. The board may decide if a pet is a nuisance or if the number is reasonable.
- Parking & vehicles: Cars must be parked in the garage; garage doors must stay closed except for entry/exit. Guest parking areas are for visitors only, and only operable vehicles may park there. No vehicle repairs visible from neighboring property. No trailers, RVs, campers, or boats may be stored outside the garage without board approval.
- Alterations & improvements: Any exterior improvement, painting, landscaping, or alteration that changes the appearance of your property requires prior written board approval. The board may reject plans based on aesthetic suitability. Inside your private courtyard, you may add plants, paving, or other improvements as long as they are not visible from neighboring property.
- Assessments: Each owner must pay annual assessments (initially capped at $1,200/year) and special assessments for capital improvements. Annual assessments can be increased above the cap by a two-thirds vote of owners. Special assessments also require two-thirds approval. Assessments are a lien on the unit and a personal obligation of the owner at the time they are levied.
- Signs: No signs visible from neighboring property are allowed except: (1) legal-required signs, (2) one owner identification sign no larger than 72 square inches, (3) a construction sign up to 3 square feet during building, (4) signs approved by the board, and (5) developer signs.
- Common walls: Owners sharing a common wall have equal rights to use it, but cannot impair its structural integrity. If an owner damages a common wall, that owner must repair it at their own cost. For damage from ordinary wear or casualty not caused by an owner, the association must repair. Disputes go to the board for final decision.
