Biltmore Gardens HOA is a townhome/condominium community in Phoenix, AZ. These rules apply to all unit owners and residents, governing use of common areas, parking, pets, pool, and property maintenance. The document replaces any prior rules.
- Use of common elements: No business or commercial activity, signs, or planting without board approval. No fireworks. Repairs for damage caused by owners/guests are assessed to the unit owner.
- Parking: Each unit gets 1 reserved space (numbered same as unit); each casita gets 2. Uncovered spaces are overflow/guest parking. No recreational vehicles (trailers, boats, campers, etc.) under carports or in patios. Abandoned or eyesore vehicles may be towed. Owners responsible for oil/chemical damage from vehicles.
- Swimming pool: Pool hours: 7 AM–10 PM Sun–Thu, 7 AM–12 AM Fri–Sat. Children 16 or under must be accompanied by an adult after 10 PM. No alcohol, drugs, weapons, food, glass, vulgarity, or pets. Pool gate must be locked; replacement key $5. No lifeguard.
- Pets: Household pets under 20 lbs allowed; larger pets require board written consent. No commercial breeding. Pets must be licensed and vaccinated (dogs 3+ months). Pet waste must be collected. No unattended pets on patios; patios must be cleaned of waste. No pets in pool area.
- Maintenance of premises: Homeowners responsible for AC units, window glass/screens, security doors (must be cream, copper, brown, or black), patio landscaping, keys. Association maintains mailboxes. Exterior improvements require board approval. Garbage must be bagged; hazardous waste not picked up.
- Patio upkeep: Patios must be neat. No propane/charcoal grills or fire pits under covered areas; electric grills allowed. Homeowners maintain trees/plants; dead trees must be removed; trees trimmed off roof. No storing appliances, furniture, or junk. Jacuzzis, spas, pools, hot tubs require board approval with proof of insurance. Holiday lights allowed 10 days before/after holiday.
- Patio privacy & lighting: Gates may be covered with opaque composite wood or sheer sun-blocking screen material (copper, black, or brown) installed professionally; other coverings require board approval. No materials (cloth, towels, foil, etc.) hung on windows, patio walls, or gates. Patio and front door lights must be white or yellow; motion detectors allowed.
- Utility, satellite, & solar installations: All utility installations require licensed/insured contractors and board approval. Cable must be in conduit, painted to match, with one entry point. Satellite dishes must cause minimal damage; wiring encased/painted. Solar energy device installations strictly regulated and require board approval.
