What Mancuso Manor's governing documents say
This is an amendment to the Declaration of Covenants, Conditions and Restrictions for Mancuso Manor, a planned area development in Phoenix, Arizona. It modifies several existing rules but does not contain the full set of governing documents. The amendment was recorded in 1985 and primarily affects parking, assessments, exterior maintenance, and vehicle restrictions.
- Parking & exclusive use: Individual owners have the right to exclusive use of the parking space adjacent to their carport, subject to other restrictions in the declaration.
- Assessments: Annual and special assessments are set at a uniform rate per lot, but lots owned by the declarant without a completed dwelling unit are assessed at 50% of the full rate and receive only half a vote.
- Late charges & interest: Assessments not paid within 30 days of the due date incur a late charge (at least $5.90 as of the amendment) and interest at 12% per annum from the 30th day. Payments are applied to the oldest outstanding balance first.
- Exempt property: Properties owned by the declarant or dedicated to and accepted by a local public authority are exempt from assessments, but no dwelling units are exempt.
- Exterior maintenance: The association provides exterior maintenance for each assessed lot, including paint, repair, and care of exterior surfaces, trees, shrubs, grass, walks, fences, and other exterior improvements. However, this does not cover glass surfaces, roofs, gutters, downspouts, rear patio areas, or landscaping within each lot's rear patio area.
- Termite & pest control: Each lot owner is responsible for termite and pest control on their own lot.
- Parking restrictions: Overnight parking of trucks or commercial vehicles larger than a 3/4-ton pickup is prohibited except within a lot's individual carport. Motorhomes, house trailers, and campers may be parked overnight only within a carport and for no more than two nights in any seven-day period. Boats may not be stored within the properties for more than 468 consecutive hours. No vehicle may block pedestrian traffic on sidewalks in front of carports.
