McDowell Mountain Estates is a single-family residential subdivision in Phoenix, Arizona, where you own your lot individually and are subject to strict HOA rules enforced by an Architectural Review Committee. The association maintains common areas and a security system; you maintain your own lot.
- Annual assessments & cost increases: Initial annual assessments were capped at $300 per lot. The board can increase assessments annually without a membership vote by the greater of: the Consumer Price Index increase or 10%—whichever is larger. Larger increases require a two-thirds member vote. Assessments unpaid for 15 days incur a late charge and become a lien on your lot; continued non-payment can result in foreclosure.
- Architectural review & improvements: No improvements of any kind—landscaping, fences, walls, antennas, solar panels, roof equipment, or changes to existing structures—can be made without prior written approval from the Architectural Review Committee. Pickup trucks of 3/4-ton or less with camper shells not exceeding 7 feet are permitted, provided they are not visible from neighboring property.
- Pets & animals: A reasonable number of generally recognized house or yard pets are permitted, though the board can determine if a specific animal qualifies and whether the total count is reasonable. No animal can make unreasonable noise or become a nuisance, and no animal shelter or structure can be visible from neighboring property.
- Leasing & rentals: You may lease your lot to a single family; you must notify the association of the lease term and lessee name. The document does not restrict lease length or impose a minimum lease term.
- Maintenance responsibilities: The association maintains common areas, private streets, and the security gate and system at Cactus Road and Frank Lloyd Wright Boulevard. You are solely responsible for your lot and its improvements. If you violate the rules or fail to maintain your property, the board can issue a 14-day correction notice; if you don't comply, the board can perform the work and charge you—the cost becomes an assessment lien.
- Party walls: Walls or fences on lot dividing lines are party walls; adjoining owners share repair and maintenance costs proportionally. If a party wall is damaged by neither owner, both owners split the rebuild cost equally. If you cause damage, you bear the full cost of protection.
