Tonto Verde Unit Nine is a standard homeowners association (HOA) community in Rio Verde, AZ. You own a lot (typically a single-family home site) and share common areas maintained by the association. The community is part of the larger Tonto Verde master planned community, which has its own association and additional rules. This document is the primary rulebook for the unit nine subdivision.
- Assessments & fees: Annual regular assessments start at $900 for improved lots and $300 for developed lots, adjusted annually by CPI. Late payments incur a 10% late fee after 10 days and 1% monthly interest. Special assessments exceeding 5% of the annual budget require a two-thirds vote of members. The developer funds deficits and owns surpluses until the transition date.
- Architectural review: All exterior changes (buildings, fences, landscaping, painting) must be approved by the Design Review Committee, whose members are appointed by the developer until the transition date. The committee reviews plans for harmony of design and location; its approval does not guarantee compliance with building codes.
- Common areas & maintenance: The association maintains common areas (private roads, recreational facilities, etc.) funded by assessments. Owners maintain their own lots except for exterior painting (covered by association). The association has a right of access to lots for maintenance. Casualty insurance proceeds are used to restore common areas; a reconstruction assessment may be levied if insurance covers at least 75% of costs.
