• Assessments & fees: Common expenses are assessed per unit based on ownership interest (1/33rd per unit after Phase II). Annual assessments cannot increase more than 5% (or the CPI increase) without a vote of the declarant (while it controls the board) and 2/3 of all owners. Late payments incur a $10 late fee and 12% annual interest. Delinquent amounts become a lien on the unit (subordinate to first mortgages). Special assessments require the same vote.
• Rules enforcement & penalties: The board may impose reasonable temporary suspensions of voting rights or use of recreational common elements for rule violations (max 60 days per violation, with notice and hearing). Monetary penalties require a pre-approved schedule voted by declarant and a majority of owners.
