What Colonia Verde's governing documents say
Colonia Verde is a condominium community in Scottsdale, AZ — you own your individual unit and share ownership of the common elements. This document is a partial set of rules: it includes a Phase II annexation and a Second Amendment to the original Declaration. It does not contain the full rulebook; for complete rules, refer to the original Declaration and its earlier amendments.
- Parking & vehicles: No boats, campers, or trailers may be parked or stored on the property. Only operative motorcycles, passenger automobiles, and standard-size pickup trucks (≤3/4 ton rating) are allowed. Commercial vehicles are prohibited, except sedans or standard pickups used for both business and personal purposes (with unobtrusive commercial markings). Repairing or rebuilding vehicles on the property is not permitted.
- What you own & maintain: Each unit owner is responsible for all maintenance, repairs, and replacements within their unit, including windows, doors, locks, interior partitioning, kitchen/bathroom/lighting fixtures, and all HVAC and utility lines serving only their unit. The association maintains the common elements (funded by common expenses).
- Assessments & fees: Common expenses are assessed per unit based on ownership interest (1/33rd per unit after Phase II). Annual assessments cannot increase more than 5% (or the CPI increase) without a vote of the declarant (while it controls the board) and 2/3 of all owners. Late payments incur a $10 late fee and 12% annual interest. Delinquent amounts become a lien on the unit (subordinate to first mortgages). Special assessments require the same vote.
- Rules enforcement & penalties: The board may impose reasonable temporary suspensions of voting rights or use of recreational common elements for rule violations (max 60 days per violation, with notice and hearing). Monetary penalties require a pre-approved schedule voted by declarant and a majority of owners.
- Amendments & voting: The Declaration can be amended by a written instrument signed by declarant (while it controls the board) and 67% of all unit owners, with additional consent from first mortgagees if required. Changes to percentage interests, common expense shares, or termination of the condominium regime require approval of declarant and 2/3 of first mortgagees or non-declarant owners.
