What Verde River Golf and Social Club's governing documents say
This document is the club governance declaration for Verde River Golf and Social Club, a master-planned community in Scottsdale, AZ. It applies to all lot owners (except certain founders) who automatically become Sub-Members of the club through the community association. It does not contain the full HOA rules; those are in a separate 'Declaration' (CCRs).
- Club membership & use rights: Every lot owner (Sub-Member) and their immediate family (spouse, unmarried children under 25 living with them) get non-exclusive license to use club facilities. If a lot is leased, the lessee (not owner) is the Sub-Member. Use rights derive from the association's Community Membership and can be terminated by Club Owner at any time.
- Dues & fees: Each owner pays Sub-Membership Club Dues: a one-time initiation fee (75% refundable on sale), a monthly club membership fee, and a pro-rata share of club expenses. Annual increases are capped at 20% over prior year. Late fees of $250 or 2% per month apply. Dues are paid to the association, which remits to Club Owner.
- Club facilities & changes: Planned facilities include an 18-hole golf course, clubhouse with fitness, dining, spa, pool, and tennis. Club Owner can add, modify, or remove facilities at any time, and can create condos/timeshares on club property. No guarantee that current amenities will remain.
- Transfer & termination: When a lot is sold, the new owner automatically becomes Sub-Member; the seller's rights terminate. Club Owner can terminate all club memberships at any time, refunding initiation fees and prepaid dues to the association. An equity conversion option exists after build-out.
- Dispute resolution: All disputes must go through mandatory binding arbitration on an individual basis; class actions are prohibited. A notice-and-repair period and mediation are required before arbitration.
- Leasing & rentals: If a lot is rented, only the lessee may use the club as Sub-Member, but both owner and lessee are jointly liable for all dues. No minimum lease term is specified in this document; check the main Declaration.
- What this document doesn't cover: This declaration does not cover general HOA rules such as architectural review, pet restrictions, parking, landscaping, or other community standards. Those are in the separate 'Declaration of Covenants, Conditions, Restrictions and Easements for Verde River' and related documents.
