This is a water-district membership covenant for the Trilogy at Verde River community in Rio Verde, AZ. It requires all property owners to pay annual assessments and fees to the Central Arizona Groundwater Replenishment District (CAGRD) as part of the community's assured water supply certification. This is not a full homeowners association declaration; it only covers groundwater-related obligations.
- Groundwater replenishment fees: Each parcel is subject to a Replenishment Assessment based on groundwater use, an Activation Fee (paid before public report), a Replenishment Reserve Fee, Annual Membership Dues, and an Enrollment Fee. Amounts are set by CAWCD (Central Arizona Water Conservation District).
- Lien for nonpayment: Unpaid Replenishment Assessments and Annual Membership Dues become a continuing lien on the parcel and are also personal obligations of the owner at the time they came due.
- Amendments: The declaration may be amended only with the written agreement of CAWCD, the Arizona Department of Water Resources, and the owners of 67% of the total area of the property.
