Melrose Gardens N. W. Unit One is a standard single-family residential subdivision in Phoenix, AZ, governed by restrictive covenants that run with the land, as recorded in 1967. These rules apply to all lot owners and are intended to maintain the character of the neighborhood.
- Land use & residential character: Lots are restricted to single-family residential use only. No business, hospital, theater, saloon, or other commercial activity is permitted. No livestock or poultry may be kept. House trailers may not stay longer than five days.
- Dwelling requirements: Only one detached single-family dwelling and one private garage or carport per lot. Minimum ground floor area is 1,200 square feet (excluding open porches, pergolas, attached garage) with a minimum cost of $7,200 (1967 dollars).
- Setbacks & building placement: Front walls must be between 20 and 65 feet from the front property line. Side walls must be at least 5 feet from side lot lines (except open carports with frame storage may be 3 feet). Rear one-third of lot allowed for garages is exempt from side setback. Adjoining lots under common ownership may be treated as a single lot.
- Fences & walls: No solid wall or fence over 3.5 feet high within 20 feet of the front lot line. Side and rear fences/walls (other than building walls) may not exceed 6 feet. Hedges over 3.5 feet are not allowed within 20 feet of the front lot line.
- Utilities & sanitation: Residential use requires installation of water flush toilets inside the building. Until sewers are available, septic tanks and cesspools must meet Maricopa County Health Department specs. Once sewer service is available, connections must be made. No planting or structures may interfere with utility easements.
- Subdivision & lot division: Lots may not be resubdivided into smaller lots, except division among adjoining lot owners or resubdivision of adjoining lots under common ownership if average area and street frontage are equal or greater than the original plat.
- Duration & amendment: Covenants run for 30 years from recording (1967), then automatically extend in 10-year periods unless a majority of lot owners agree to change them in whole or in part.
