It primarily controls construction and design through an architectural review process and imposes specific height, setback, and landscape requirements per site. This document binds property owners and successors, and is enforced by an Approving Agent (initially the developer, later an owners' association).
- Architectural review & approval: All improvements require prior written approval of plans by the Approving Agent (developer initially, then the Association). Approval is based on conformity and harmony with the overall development. Plans are deemed approved if not acted upon within 60 days (or 105 days if extended). Construction must start within one year of approval or it expires.
- Building height & setback restrictions (by site): Site C: max 2 stories/32 ft, set back 150 ft from north boundary. Site D: max 2 stories/32 ft, office use only. Site E: max 2.5 stories/40 ft, two-story buildings set back 85 ft from north/east boundaries abutting single-family lots; no second-story balconies facing those single-family homes. Site H: max 1 story/16 ft.
- Landscape buffers & easements: Sites C and E require a 10 ft landscape buffer along specified boundaries with box-sized trees (min 10 ft high) spaced 20 ft center-to-center with automatic watering. Vehicular non-access easements (1 ft wide) are established along certain boundaries of Sites C and E to prevent vehicle access.
- Density limitation: Site E has a maximum density of 22 units per acre.
- Enforcement & remedies: The Approving Agent may enforce restrictions through legal action or by entering the site to correct violations after 30 days' notice. Costs and attorneys' fees, plus 18% interest, are charged to the owner. However, the Approving Agent has no duty to enforce and is not liable for failure to enforce.
- Duration & amendment: Restrictions run with the land for an initial 10-year term, auto-renewing for 5-year periods unless terminated by recorded instrument with all owner and first mortgagee consent. The developer (Declarant) may amend unilaterally while it owns any portion of the property to facilitate development.
- Developer's reserved rights: The Declarant is not bound by the restrictions on sites it develops or markets itself, and may abandon or modify development plans without consent of other owners.
