What Mobile Gardens's governing documents say
Mobile Gardens is a manufactured home community in Wittmann, AZ (Units I & II) governed by a Declaration of Restrictions (1989 Revised Edition). It sets rules for landowners (lot owners) in a single-family, residential subdivision for manufactured homes, with no leased lots or rentals allowed. All lots must be occupied by a single manufactured home of at least 720 square feet.
- Occupancy & dwelling type: Each lot is for one single-family manufactured home (minimum 720 sq ft) only. No other residence, motor home, or travel trailer may be used as a dwelling, but motor homes/travel trailers may be stored if not detrimental to appearance.
- Pets & livestock: No horses, mules, goats, cows, chickens, pigs, or other livestock/fowl. Dogs must be kept on a leash or enclosed in a yard.
- Leasing & rentals: No renting or leasing of any manufactured home, structure, or lot is permitted.
- Architectural review & structures: No home may be placed without written approval as to size, condition, and appearance. Cabanas, porches, rooms, or storage sheds must blend with the home's color and be approved in writing. Only new materials (wood, stone, cement, plastic, metal, etc.) may be used unless approved.
- Setbacks & fences: Manufactured homes and structures must be at least 20 ft from front property line, 5 ft from side lines (10 ft on exterior lots), and 25 ft from rear. Front-yard fences cannot exceed 3 ft in height, unless needed for swimming pool safety.
- Parking & vehicles: No washing machine or other appliances may be kept outside. No large construction machinery, dump trucks, tractors, or blades may be parked on a lot. No vehicles or equipment may create a fire hazard or public eyesore.
- Lot maintenance & appearance: All occupied lots must be maintained to avoid fire hazard or public eyesore. Homes must have skirting installed within 90 days. Clotheslines must be in the rear of the lot.
- What this document doesn't cover: This document does not mention HOA fees, assessments, insurance requirements, common areas, community amenities, board elections, meeting procedures, or enforcement penalties (beyond court action). It does not state a management company or address age restrictions, though it is a residential subdivision.
