Royale Gardens II is a condominium community (Horizontal Property Regime) in Phoenix, AZ, governed by these Restated By-Laws. You own your unit and share ownership of common elements. The association maintains common areas and carries master insurance, but owners may be required to insure their own units.
- Use of units & leasing: Units must be used as private dwellings. Leasing is permitted without minimum term restrictions. Each unit may keep up to one dog, cat, or bird without board approval; additional pets require majority board consent.
- What you own & maintain: You are responsible for maintaining the interior surfaces (ceilings, floors, walls), doors, windows, and storage area of your unit. The association maintains and insures common elements. You may not interfere with structural integrity.
- Assessments & fees: Monthly assessments are levied per unit (1/44 share of total expenses) to cover common costs. The board can impose special assessments for deficits. Unpaid assessments create a lien on your unit, and the board can foreclose.
- Architectural review: Any exterior improvement or change requires prior written approval from the Architectural Committee. The committee has at least four members (no more than two from the board). Rules are adopted by owner vote.
- Access & inspections: The board, its agents, and employees have an irrevocable right to enter your unit during reasonable hours for maintenance, repair, or emergency, at owner's cost for emergencies.
- Insurance: The board obtains hazard and liability insurance for buildings and common elements. As an option, owners may be required to purchase their own building coverage, with assessment adjusted accordingly.
- Damage or destruction: If damage affects up to 43 units, insurance proceeds for interior damage go to the owner; exterior damage proceeds go to the board as trustee. If 44 units are destroyed, a special meeting decides whether to rebuild. If not rebuilt, the regime may be terminated.
