Morten Villas Condominium is a condominium community in Phoenix, AZ. This document is a First Amendment to the original Declaration of Covenants, Conditions and Restrictions, recorded in 1988, by which the developer added Phases 2 through 4 to the project. It does not contain the full rules governing residents; rather, it exercises a development right and defines how units in the new phases contribute to common interests, voting, and expenses.
- Development rights & phasing: The developer (Metro-American Homes) reserved the right to add phases to the condominium project. This amendment adds Phases 2, 3, and 4, each containing specific condominium units (Phase 2: units 13–24; Phase 3: units 8–12; Phase 4: units 1–7). The addition becomes effective when the first unit in a phase is sold to a non-developer owner.
- Allocation of interests: For common interests, each unit gets a fraction with numerator 1 and denominator equal to the total number of units in the project. Each unit has one vote. Common expenses are shared equally among all units, except as otherwise provided in the Declaration or Arizona Condominium Act.
- Limited common elements: Each new unit is assigned limited common elements including a porch, patio, storage room, and rear yard as shown on the recorded map, plus other limited common elements as described in the original Declaration.
- What this document doesn't cover: This amendment does not contain the full set of rules for owners (e.g., pet limits, leasing restrictions, maintenance obligations, or assessment amounts).
