Optima Biltmore Towers is a condominium community in Phoenix, AZ — you own your individual unit and share ownership of the building's common elements, which the association maintains. This declaration sets the rules for all unit owners, residents, and guests. It includes residential, commercial, and utility units, each with different use restrictions.
- Leasing & rentals: Leases must be for at least 90 days, and no unit may be leased more than four times in any 12-month period. Subleasing is prohibited. Owners must provide the association with a copy of the lease and contact information at least 10 days before the lease starts. The owner remains liable for any violations by tenants.
- Pets: Only domestic pets (dogs, cats, fish, birds) are allowed, in a 'reasonable number' determined by the board. Dogs must be leashed outside the unit and feces must be cleaned up. - Antennas & satellite dishes: No TV antennas or radio receivers/transmitters except that a satellite dish of 18 inches or less in diameter may be installed on a limited common element (like a terrace) with board approval. The dish cannot be mounted to the building exterior or cause any building penetrations.
- Window coverings: Window coverings must be a specific MechoShade product (ThermoVeil ShadeCloth/Basket Weave Series, #2104 Black/Brown 13% OF, or #1004 Black/Brown 2-3% OF for units under terraces). No reflective materials, aluminum foil, or window tinting (except original construction) are allowed.
- Terraces: Furniture and plants on terraces must be neutral colors harmonious with the building. No items may extend above the terrace wall, no umbrellas are allowed, and terraces may not be used for storage of non-terrace items (like bicycles or exercise equipment). No hanging of linens, rugs, or swimsuits.
- Business use: Residential units may be used for home businesses only if the activity is not detectable from outside (no sight, sound, vibration, or smell), conforms to zoning, is conducted solely within the unit, does not involve solicitation of other owners, and is consistent with the residential character. Leasing is not considered a business.
- No time-sharing: Units may not be divided or conveyed on a time-share basis (rotating use for periods of 180 consecutive days or less).
