What Biltmore Financial Center Association's governing documents say
Biltmore Financial Center is a commercial office and retail complex in Phoenix, AZ. This document is a 1993 amendment to the master Declaration of Covenants, Conditions, Restrictions, Assessments, Charges, Servitudes, Liens, Reservations and Easements. It specifically amends parking easement allocation among parcel owners and adds maintenance obligations tied to a Reciprocal Easement Agreement. This is not a full rulebook and covers only limited aspects of property governance.
- Parking allocation: Parking spaces (underground and surface) are allocated among parcel owners (except the Northwest Parcel) based on relative building floor area. The Northwest Parcel receives no allocation from other parcels. The Association determines location and configuration, subject to certain proximity and relocation conditions.
- Parking easements & reservations: Each owner has the right to exclusive use of parking spaces allocated to its parcel. Reserved parking rights under Section 11.05 are subject to rights granted in the Reciprocal Easement Agreement with First Interstate Bank.
- City parking requirements: New construction on the Southeast or Northeast parcels must ensure total parking spaces meet City requirements (currently one space per 250 square feet). An owner may request a variance that would reduce spaces by more than 105 below that ratio only with all owners' consent.
- Maintenance obligations: The Association must maintain, repair, and replace easement property and perform all obligations under the 1993 Reciprocal Easement Agreement.
- What this document doesn't cover: This amendment does not address typical residential rules such as pet limits, leasing restrictions, age restrictions, or assessments amounts. It only modifies parking and maintenance provisions of the original Declaration. For full community rules, refer to the original Declaration and other governing documents.
