Osborn Circle is a single-family home HOA in Phoenix, AZ. These Covenants, Conditions, and Restrictions (CC&Rs) govern all lots in the community, binding owners, residents, and guests. The rules cover architectural design, land use, and property maintenance to preserve the residential character.
- Architectural review: Any exterior change visible from neighboring property requires prior written board approval. The board has 45 days to decide after a complete submission, and may disapprove based on aesthetics alone. Minimum livable square footage is 3,200 sq ft; no home exceeds two stories.
- Leasing & rentals: Leases must be in writing for a term of at least 6 months. A copy must be provided to the association before occupancy, along with owner contact info and tenant names. Home exchanges and foreign student programs with no or nominal consideration are not considered leases.
- Pets: No more than 4 adult dogs per lot, plus cats and common domestic birds. Pets must be leashed (max 6 ft) when outside the lot, and owners must immediately remove droppings. Pet structures must not be visible from neighboring property. The board may adopt additional size/number restrictions, with existing pets grandfathered.
- Parking & vehicles: Commercial vehicles (RVs, boats, trucks over 1 ton, etc.) may not be parked visibly except for 24-hour loading/unloading or inside a garage. Family vehicles (cars, pickups under 1 ton, SUVs, etc.) may park on the driveway. Overnight parking on common area private roads is prohibited. Vehicles may be towed or booted for violations.
- Business use: No trade or business may be conducted on a lot, but home-based businesses are allowed if not detectable from outside, involve no more than one non-resident employee, generate minimal traffic, and comply with zoning. The board determines whether an activity constitutes a nuisance.
- Signs & flags: Signs are generally prohibited except for small identification signs (6x12 inches), one standard 'for sale' sign, political signs (max 24x24 inches, displayed 45 days before to 7 days after election), and flags allowed by state law. 'For lease' signs are banned.
- Garage & storage: Garages must be used primarily for vehicle parking and must not be converted to living space without board approval. Garage doors must be kept closed when unattended. Storage that blocks vehicle parking is prohibited. Garage sales inviting the public are not allowed, but the board may coordinate community-wide sales.
- Setbacks & drainage: All buildings must comply with minimum setbacks established by city ordinance. No improvement may obstruct drainage as shown on the approved drainage plan or the plat.
