Paloma Paseo is a standard single-family home community in Phoenix, AZ. Owners own their lot and home, and a homeowners association (HOA) manages common areas and enforces rules. These CC&Rs bind all property owners.
- Homeowners Association (HOA): The HOA is run by a board of directors elected by members (lot owners). Membership is automatic with ownership; each lot gets one vote. The Declarant (developer) had extra voting power until 2010 or until Class A votes equaled Class B. The board can adopt rules and impose late charges or liens for unpaid assessments.
- Annual assessments & fee increases: The annual assessment (initially $358.08 per lot) can increase each year by up to 10% or the Consumer Price Index, whichever is higher, without a membership vote. Larger increases require a two-thirds vote of owners. Special assessments for capital improvements also need two-thirds approval. Assessments are a personal obligation and a lien on the lot if unpaid.
- Architectural review & approval: Any exterior improvement visible from neighboring property—including buildings, fences, landscaping, color changes, antennas, basketball hoops, flagpoles—requires prior written approval from the Architectural Committee. Applications must include plans and a fee. The committee has 45 days to act; if it fails to, approval is deemed given. The committee can refuse approval for aesthetic or other reasons.
- Parking & vehicle rules: All vehicles must be parked in garages, carports, or driveways. Guests and invitees may park on public streets adjacent to sidewalks for no longer than four hours at a time. Commercial vehicles and business equipment cannot be parked where visible from neighboring property, common areas, or streets.
- Pets & animals: Only a reasonable number of common household pets (like dogs and cats) are allowed, kept as domestic pets only—no commercial breeding. Pets must not create nuisance noise. Structures for pets (kennels, pens) must not be visible from neighboring property. The board can decide whether a pet or number is reasonable.
- Landscaping & exterior maintenance: Owners must keep their landscaping trimmed, cultivated, and free of weeds and debris. Front yard landscaping must be approved in writing by the Architectural Committee and installed within 90 days of closing. All landscaping must comply with City of Scottsdale ordinances. The association can enter a lot to maintain drainage or common-area landscaping.
- Other use restrictions: Outdoor antennas, clotheslines, and machinery/equipment visible from neighboring property are prohibited or require approval. No nuisances (odors, debris, excessive noise). Outdoor lighting must be shielded to not spill onto adjacent lots. No mineral extraction or activities that alter natural drainage. Natural Area Open Space (NAOS) must remain in natural desert state.
