What Paradise Valley Palms's governing documents say
Paradise Valley Palms is a single-family residential subdivision in Phoenix, AZ. These covenants, conditions, and restrictions (CCRs) run with the land and bind all lot owners. The document sets rules for home construction, setbacks, fences, vehicles, and an architectural review process, but does not create a homeowners association or impose mandatory fees.
- Minimum home size & design: Each dwelling must have at least 1,000 square feet of ground floor area (excluding garage, porches, patios) and be no more than one story. Only one residence is allowed per lot. No buildings may be moved onto a lot from another location.
- Setbacks & building placement: Front walls must be 30–40 feet from the front property line. Side walls on interior lots must be at least 7 feet from the side lot line; on corner lots, street-side walls must be at least 10 feet from the side street line and interior side walls at least 5 feet. Eaves and cornices may project up to 2 feet from side walls, but no projection closer than 1 foot to any lot line. Detached garages on the rear third of a lot have different rules.
- Fences & landscaping: No solid wall or fence over 2.5 feet high is allowed nearer the front street than the front wall of the house (or 30 feet from the front line on vacant lots). Side and rear walls or fences may be up to 6 feet high. No hedge over 3 feet tall is permitted closer than 20 feet to the front lot line.
- Livestock & vehicles: No livestock may be kept on any lot. All trailers, campers, motor homes, and boats must be stored in the rear half of the lot.
- Architectural review: No structure may be started until its design, location, and materials are approved in writing by a two-person committee (initially Ellis W. Suggs and John T. Owens, later elected by lot owners). If no committee exists or no action is taken within 30 days of a written request, approval is not required as long as the building complies with all restrictions and is in harmony with nearby buildings.
- Term & amendment: These covenants run with the land until June 1, 1995, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them in whole or in part.
- What this document doesn't cover: This document does not create a homeowners association, impose monthly or annual fees, regulate leasing or rentals, restrict occupancy based on age, or provide for common area maintenance. It is a set of use restrictions enforceable by court action.
