What Shea Patio Villas's governing documents say
Shea Patio Villas is a standard single-family home HOA in Phoenix, AZ. All owners and residents are bound by these CC&Rs, which cover what you can do with your property, leasing, pets, vehicles, and how the association is run. The rules are enforced by the homeowners association.
- Leasing & rentals: No more than 15% of lots may be leased at any time. Leases must be for exactly 12 months (neither shorter nor longer). Owners must submit lease agreements and a tenant registration form to the association before executing or extending a lease, and pay a required security deposit. 'For Rent' signs are prohibited.
- Architectural review: Almost all exterior changes (including construction, painting, landscaping alterations) require prior written approval from the Architectural Committee. Submit detailed plans; the committee has 45 days to respond. A fee and a refundable deposit may be required.
- Pets: No more than two dogs per lot (any size/weight). Only house pets allowed; must be kept on a leash no longer than 6 feet when outside the lot. Owners must clean up after pets. No pet structures visible from outside.
- Parking & vehicles: No trucks, trailers, RVs, boats, or commercial vehicles may be parked anywhere except in a lot's carport. Only basic family vehicles allowed. Major vehicle repairs and inoperable vehicles prohibited; towing at owner's expense.
- Use restrictions: All units must be used as a residence for a single family (related group or up to 3 unrelated persons). Businesses are allowed only if not detectable from outside. No nuisances, odors, or loud noises. Temporary buildings or structures for residence are prohibited.
- Assessments & fees: Annual assessments are levied per lot and can be increased up to 10% without member vote; any increase above 10% needs majority approval. Special assessments require 67% member vote. Late payments incur interest, late fees, and potential liens. Fines can be imposed for rule violations.
- Maintenance responsibilities: Owners must maintain their own lots, buildings, and improvements. The association maintains all common areas. The association has an easement to enter lots for inspection, maintenance, or emergency repairs. If an owner fails to maintain, the association may step in and charge the owner.
