Enclave At 32N Street is a standard single-family home subdivision in Phoenix, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) applies to all owners of the 31 lots. It establishes the 32 North Homeowners Association, which maintains common areas and can levy assessments, and binds owners and their tenants to use restrictions.
- What you own & maintain: You own your lot and the house on it. The association maintains the common areas (Tracts A-H) and carries master insurance (liability, property, etc.). You must keep your lot and home in good repair, including roof, walls, and landscaping.
- Leasing & rentals: Leases must be for the entire lot and dwelling unit, for a minimum of 30 days. Transient or hotel use is prohibited. You must provide the association with a copy of the lease and the tenant's address before occupancy. You are responsible for your tenants' conduct.
- Pets: Only customary household pets (dogs, cats, birds) are allowed, in reasonable number and type as determined by the Board. Animals must be leashed or fenced on your lot and waste must be promptly removed from common areas and other lots.
- Parking & vehicles: Park commercial or recreational vehicles (boats, RVs, trailers) only if not visible from neighboring property. No commercial vehicles on common area. Street parking limited if garage space is available. Garage doors must be kept closed except for ingress/egress.
- Architectural review: Any exterior alteration (construction, painting, landscaping changes) requires prior written approval from the Architectural Control Committee. Solar collectors, antennas, and satellite dishes are subject to specific restrictions and Committee approval.
- Assessments & fees: Annual assessments start at $1,200 per lot, automatically increasing each year by up to 5% or CPI. Special assessments require approval of Declarant (while Class B exists) and 2/3 of Class A votes. A working capital fee and reserve contribution fee are due at purchase. Late payments incur 18% interest and a 10% late charge.
