Plaza Del Rio is a mixed-use planned community in Peoria, AZ, allowing retail commercial, medical, and residential uses. This document is the First Amendment to the original Declaration of Covenants, Conditions and Restrictions, recorded in 1987. It supplements the original rules and binding all owners and their successors. The community currently operates with an Architectural Committee that oversees property standards and assessments until an official homeowners' association is formed.
- Use restrictions: The property must be used for retail commercial, medical, residential, or other uses approved by the Architectural Committee. No outdoor antennas, temporary occupancy, or signs visible from neighboring parcels or streets are allowed except limited construction or sale signs.
- Architectural review: Any exterior alteration, improvement, or landscaping change requires prior written approval from the Architectural Committee. The committee has sole discretion and may charge fees. If the committee fails to act within 30 days after final plans (or 14 days after a demand), approval is deemed granted.
- Assessments: Until an association is formed, the Architectural Committee levies assessments to cover security, maintenance, and improvements. Annual and special assessments (for capital improvements) are based on a uniform rate per square foot of land owned. Delinquent assessments accrue 18% annual interest and become a lien on the property.
- Association formation: An owners' association, 'The Plaza Del Rio Owners' Association, Inc.,' may be established once 60% of the property is developed, or by majority vote of owners holding at least 25% of the property. The board consists of five directors, and voting rights are one vote per square foot owned.
- Duration and amendment: The covenants run for 30 years from the recording date (1987), automatically renewing for successive 10-year periods unless terminated by owners holding 60% of the property. Amendments require a signed instrument by owners holding two-thirds of the property.
