Ponderosa Homes North is a single-family residential subdivision in Phoenix, AZ, governed by a Declaration of Restrictions recorded in 1972. These rules apply to all lot owners and residents, defining what you can build, use, and do on your property. The covenants run with the land until 2001 and automatically renew every 10 years unless a majority of owners vote to change them.
- Property use & zoning: All lots are restricted to single-family residential use only. No business, hospital, theater, saloon, or other commercial activity is allowed on any lot.
- Building & construction: Only one detached single-family dwelling and a private garage or carport may be built per lot. Minimum dwelling size is 750 square feet (excluding carports, storage, porches, and pergolas). Construction must be brick, cement block, or other substantial masonry or insulated frame. No prefabricated or moved buildings are allowed, except temporary sales/construction offices that must be removed after construction.
- Setbacks & placement: Front and rear building lines must be at least 25 feet from property lines. Interior side walls must be at least 7 feet from side lot lines; corner lots require at least 10 feet from the side street line. Carports must be at least 3 feet from any lot line.
- Fences & walls: No solid wall or steel fence may be closer to the front street than the front wall of the house (or within 25 feet if no house exists). Maximum fence height is 6 feet. Corner lots have additional restrictions for side street boundaries.
- Activities & nuisances: No noxious or offensive activity is permitted. No livestock or poultry may be kept. No hospital, sanitarium, or similar care facility is allowed.
- Signs: Only one sign per lot, not exceeding 12 inches by 18 inches, for 'For Sale' or 'For Rent' (with owner/agent contact info) is permitted. The subdivider may also maintain sales signs.
- Utilities & drainage: Easements for utilities and drainage are reserved. No structures, planting, or materials that may interfere with utilities or drainage are allowed in easements. The lot owner must maintain the easement area, except for improvements maintained by public authorities or utility companies.
- Duration: These covenants run with the land until January 1, 2001, and automatically extend for successive 10-year periods unless a majority of then-owners agree to change them.
