This is a condominium (horizontal property regime) for Greenway Springs in Phoenix, AZ, consisting of 240 apartments (units). The declaration establishes the Greenway Springs Homeowners' Association to manage the property and common elements. Unit owners automatically become members of the association and are bound by the declaration, bylaws, and rules.
- What you own & maintain: You own the airspace of your apartment, including interior surfaces but not structural components, pipes, wires, or ducts serving other units. Patios/balconies, HVAC units, and storage lockers designated on the plat are common elements for your exclusive use and must be maintained by you. The association maintains all common elements, including exterior walls, roof, and shared facilities like pools and parking areas.
- Assessments & fees: Each unit pays a proportionate share of common expenses based on its common element interest. Regular assessments are set annually by the board and paid monthly; special assessments may be levied for unanticipated expenses. Payments are due by the 15th of each month, and late payments accrue interest at the highest legal rate. Unpaid assessments create a lien on the unit, which can be foreclosed.
- Voting & membership: Each unit gets one vote. If a unit has multiple owners, they collectively cast one vote. Voting rights are suspended if an owner is more than 15 days late on assessments after written notice. Owners do not vote until control transfers from the declarant (developer) to the owners, which occurs by March 1984, sale of 180 units, or declarant's voluntary relinquishment.
- Alterations & improvements: Nonstructural changes inside your unit do not require board approval, but you are liable for any damage caused. Structural alterations need a licensed engineer's certification that they won't impair structural integrity and prior written board approval. Any alteration visible from outside the building also requires board approval for aesthetics.
- Maintenance responsibilities: You maintain your unit's interior surfaces, appliances, windows and doors, and HVAC equipment (unless it's part of the common elements). The association maintains structural components, common elements, and utility lines serving multiple units. You cannot paint or change the exterior appearance without board approval. If your actions damage common elements or another unit, you bear the cost (unless covered by association insurance).
- Party walls: Walls between apartments are party walls. If a party wall is damaged by an owner's negligence, that owner must repair it at their own cost. If damaged by other causes, the association repairs it. Any alteration to a party wall requires board consent. Disputes over party walls are settled by arbitration.
