Puerta Del Sol is a residential subdivision in Phoenix, AZ, governed by a homeowners' association (Puerta Del Sol Homeowners’ Association). Lots consist of single-family dwellings or apartments, with some party walls between adjoining properties. These deed restrictions, recorded in 1968, run with the land and bind all current and future owners.
- Permitted uses: Lots are for residential use only—high-class single-family dwellings or apartments. No business, commercial activity, or institution is allowed. One "For Rent" or "For Sale" sign per parcel is permitted.
- Pets & animals: No livestock or poultry may be kept. Only ordinary household pets are allowed.
- Maintenance & upkeep: Each lot must be kept free of rubbish and garbage, with trash cans, clotheslines, and equipment screened from view. The association can enter a lot to make necessary repairs if the owner fails to maintain it, and charge the owner.
- Architectural review: No building, fence, wall, or other structure may be built or altered without prior written approval of the Board of Directors. Plans must be submitted showing shape, height, materials, floor plans, location, and cost. Approval is based on aesthetics, suitability, and effect on neighboring properties.
- Party walls: Walls built on the dividing line between lots are party walls. Each adjacent owner shares rights and duties. Damage caused by one owner must be repaired by that owner; other damage is shared equally. Modifications require adjacent owner consent and board approval. Disputes go to arbitration.
- Leasing & transfers: Any sale, lease, or sublease requires written notice to the board along with an application from the proposed buyer/tenant. The board has 15 days to approve or disapprove, and during that time has the option to purchase or lease the lot on the same terms. If the board disapproves but doesn't exercise the option, the transfer can still proceed if certain conditions are met (e.g., approval of half the lot owners).
- Assessments & fees: Each lot owner pays a prorated share of the association's maintenance, improvement, taxes, and reserve costs. Total annual assessments per lot may not exceed $100 unless owners of at least 51% of lots consent in writing. Unpaid assessments become a lien on the lot and can be foreclosed.
- Duration & amendments: The restrictions run for 10 years from March 1968, then automatically renew for successive 5-year terms unless revoked or amended by a recorded instrument signed by owners of at least 75% of lots within 90 days before expiration.
