Raintree Resorts Casitas Condominiums is a master-planned condominium community in Phoenix, AZ with phased expansion rights. You own your individual unit and share ownership of common elements (grounds, parking, structures); assessments and voting rights are allocated equally per unit.
- What you own & maintain: You own your unit's interior (walls, floor, ceiling, to half-depth of shared party walls) and your garage for parking and storage. You maintain your unit, garage, and allocated limited common elements (patios, balconies, meters). The association maintains all common elements; covered parking is association-maintained.
- Use restrictions: Units are single-family residential only—no commercial businesses (though personal professional libraries and personal business calls at home are allowed). No solar panels, satellite dishes, antennas, or outside clotheslines visible from neighboring properties without Architectural Committee approval. No incinerators, temporary structures (except during construction), or motor vehicle repair work visible from outside.
- Alterations & improvements: Non-structural interior changes don't need approval. Structural alterations and anything visible from outside require Architectural Committee approval plus certification from a licensed Arizona engineer. You are liable for any damage your alterations cause to common elements or neighboring units.
- Parking & vehicles: Covered parking spaces are allocated to units and maintained by the association; additional general parking is available. Motor vehicles cannot be repaired or serviced if visible from neighboring properties, and inoperable vehicles cannot be stored visibly.
- Architectural review & approval: The Architectural Committee (at least 3 members appointed by the Board) must approve external modifications, structural changes, solar/satellite devices, and anything visible from neighboring property or exterior of buildings.
- Assessments & common expenses: Common Expense Assessments are divided equally per unit (base maximum $135/month in year one). The Board can increase assessments annually by up to 20% based on the Consumer Price Index; increases beyond 20% require a two-thirds member vote. Special assessments can be levied for major repairs; unpaid assessments create a lien on your unit.
- Voting rights & governance: Each unit has one vote, regardless of garage ownership. During the declarant's initial control period (through 90 days after 75% sale or 4 years from end of developer sales, whichever is earlier), the developer appoints the board. Afterward, unit owners elect a board of at least 3 unit-owner members.
