What Astragal Condominiums's governing documents say
Astragal Condominiums is a small condominium community in Scottsdale, AZ, consisting of 3 units. This Declaration of Condominium establishes the rules for owning and living in a unit, covering use restrictions, maintenance responsibilities, and financial obligations. It binds all unit owners, tenants, and residents.
- Residential use & home business: All units must be used exclusively as residences. Home businesses are allowed only if they are not detectable from outside the unit, comply with zoning, do not involve visitors or solicitation, and do not create a nuisance. Leasing a unit is not considered a business.
- Rental of units: Units may be leased only in their entirety, with a written lease that acknowledges the Declaration and Rules. Subleasing and lease assignments are prohibited. The owner must notify the association at least 10 days before the lease starts, providing the lease term, tenant names, owner's contact, and emergency contact. The owner remains liable for tenant violations.
- Pets: No more than two 'Permitted Pets' per unit. Permitted pets are dogs, cats, or household birds kept as domestic pets, not for commercial purposes. Dogs must be leashed outside the unit; owners must clean up waste. The board may adopt rules on pet size/weight, but such limits require member vote approval.
- Assessments & fees: Common expense assessments are divided equally among the 3 units (1/3 each). The board sets the budget and assessment amounts. Special assessments require a 2/3 member vote. A working capital fund equal to two months' assessment is due from each initial buyer. A transfer fee is also charged upon sale. Delinquent assessments bear interest and late fees, and the association has a lien on the unit.
- Alterations & improvements: Nonstructural interior changes may be made without board approval, but the owner is liable for any damage. Structural changes or any alteration visible from outside (including patio enclosures) require prior written board approval, which must find the change aesthetically harmonious. No alterations to common elements without board approval.
- Parking & vehicles: Parking is only allowed in designated spaces. Trucks, trailers, campers, boats, and recreational vehicles may only be parked in garages that are part of a unit. Inoperable vehicles and repairs on common property are prohibited. The board may tow violators at the owner's expense.
- Common elements & maintenance: The association maintains all common elements (including patio walls) except limited common elements assigned to units. Unit owners must maintain their unit's interior and certain limited common elements (e.g., exterior doors, windows, patio interiors). The association may enter units for inspection or emergency repairs.
