Rio Salado Gateway Center is a commercial industrial center in Phoenix, AZ, governed by a Declaration of Restrictions that runs with the land. This document binds all property owners within the development, focusing on design, use, and maintenance standards for the benefit of the entire business park.
- Permitted Uses: Sites may be used only for manufacturing, distribution, assembly, processing, storage, wholesale, office, laboratory, research, or development. Retail, hotel, restaurant, or bar uses require prior written approval from the Approving Agent, which can be granted or denied in its sole discretion. Uses that create odors, fumes, noise, glare, or other nuisances are prohibited.
- Construction & Design Standards: Buildings must be set back at least 30 feet from street curbs and at least 10 feet from neighboring sites. Maximum building coverage is 70% of site area, with ground-floor area not exceeding 50%. Exterior walls must be tilt-up reinforced concrete, masonry, or other approved materials. Roof elevation changes of more than 2 feet require approval.
- Architectural Review: All plans, construction, alterations, exterior changes (including paint colors), and grading require prior written approval from the Approving Agent, which has complete discretion. Approvals are not binding for future projects. Construction is deemed approved 3 months after written completion notice if no enforcement suit is filed.
- Landscaping & Parking: At least two-thirds of the setback area from streets must be lawn or landscaping (subject to approval). Adequate off-street parking must be provided to eliminate on-street parking; parking is prohibited within 15 feet of street property lines. At least 2% of parking areas must contain landscaped islands. Loading areas must be screened from view.
- Maintenance & Storage: All exteriors, walks, driveways, and landscaping must be kept in good repair; painted surfaces must be repainted at least every 4 years. Materials, supplies, and equipment must be stored inside or behind a solid visual barrier. Roof-mounted equipment must be screened if it projects more than 1.5 feet above the roof.
- Signage: No signs visible from neighboring sites or public streets may be placed without prior written approval from the Approving Agent.
- Enforcement & Assessment Liens: The Approving Agent has the exclusive right to enforce restrictions and can enter a site to abate violations after 60 days' notice, with costs assessed as a lien on the property. Delinquent assessments bear interest at 2% above prime rate and may be foreclosed. Attorneys' fees are recoverable.
- Duration & Amendments: Restrictions run for 30 years from recording (1984), automatically renewing for 5-year periods unless terminated. Amendments require written consent of owners of 75% of total square footage, and for at least 15 years or until the Approving Agent owns less than 20%, the Approving Agent's consent is needed.
