What Rio Seco II's governing documents say
Rio Seco II is a single-family home subdivision in Phoenix, AZ, established by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that run with the land. This document sets use restrictions and architectural controls for the 26 lots, but does not create a homeowners' association with mandatory dues or an assessment structure.
- Land use & setbacks: All lots are for single-family residential use only. No business, commercial activity, or institutions are permitted. Minimum front setback is 15 feet; side and rear fence/wall lines must remain as originally constructed by the developer.
- Minimum house size: Each dwelling must have a ground floor area of at least 950 square feet, excluding open porches, porches, and attached garages, unless approved in writing by the Architectural Committee.
- Pets: Dogs, cats, and other household pets are allowed, but not for commercial breeding or maintenance. The number of pets must not create a nuisance in the opinion of the Architectural Committee. Animal waste must be disposed of per local laws.
- Architectural review: No building, fence, wall, antenna, or other structure may be erected or altered without prior written approval of plans by the Architectural Committee or Original Developer. The committee has 15 days to reject; failure to reject constitutes approval. Rejection must be reasonable.
- Fences & walls: Side and rear fences/walls may be no more than 7 feet high and must be cement block construction (unless otherwise approved). They must remain at locations originally installed by the developer. Color and materials cannot be changed without approval. Dividing line fences are maintained jointly by adjoining owners.
- Vehicles & parking: No inoperative, abandoned, or dismantled vehicles may be stored on any lot where visible from other lots or streets. No campers, boats, trailers, or recreational vehicles may be parked in front of a lot or in a front driveway visible from the street except for temporary parking. No overnight truck or RV parking in streets.
- Landscaping: Landscaping must be installed and substantially completed within 6 months of close of escrow, unless already installed by developer. Each owner must maintain landscaping in a neat and attractive manner. The Architectural Committee may do work after 15 days' notice if owner fails, and charge the owner.
- Easements (Perpetual Use Maintenance Areas): Specific lots have perpetual use maintenance area (PUMA) easements, generally 5-foot strips, benefiting adjacent lots. These areas may be used as yard extensions, must be landscaped, cannot have permanent structures, and are maintained by the benefiting owner. They remain subject to drainage and utility easements.
