Safari Shadows is a condominium community in Phoenix, AZ — you own your individual unit and an undivided 1/13th interest in the common areas, which the association maintains and governs. This document from 1981 establishes the condominium regime, the homeowners' association, and the system of assessments and enforcement.
- What you own & maintain: You own a unit (defined by horizontal and vertical boundary planes) plus an undivided 1/13th interest in the common areas, which include recreational facilities, parking, walkways, and the swimming pool. The association is responsible for maintaining the common areas; you maintain the interior of your unit and any limited common elements like assigned parking or patio.
- Assessments & fees: The minimum regular assessment is initially $50 per month per unit, payable on the first of each month. The board may increase this amount, but it cannot fall below $50. Supplementary assessments may be levied for unexpected expenses. Special assessments can be charged to individual owners for costs attributable to their unit.
- Late payments: If an assessment is not paid within 15 days after the due date, a late charge of $50 (or such other amount as the board determines) is added, and the unpaid balance bears interest at 18% per annum. The association may file a lien or sue the owner personally.
- Voting & membership: Each unit owner automatically becomes a member of the association. Initially, the developer (Declarant) holds voting control with 3 votes per unit owned; after transfer of control to owners, each unit gets 1 vote.
