The community is still under the developer's control, which expires either 90 days after 75% of units sell or 4 years after the developer stops marketing units.
- What you own & maintain: You own your unit's interior finished surfaces and any fixtures within. The association maintains all common elements (structure, grounds, utilities). You're responsible for maintenance of any limited common elements allocated to your unit, like your patio or balcony, and for any damage your negligence or willful conduct causes.
- Assessments & fees: Per-unit common expense assessments cover association costs and maintenance. With 4 units, each pays 1/4 of common expenses. The association has a lien on your unit to secure payment of assessments, penalties, and other charges.
- Leasing & rentals: You may lease your entire unit, but lease terms must be at least for the full unit (no partial rentals). All leases must be written and include language making the lessee subject to the condominium documents; lessee violation of those documents is grounds for lease default. You must notify the association of lease start/end dates and lessee names.
- Pets: Only one domestic pet per unit, not to exceed 20 pounds. Only unit owners may keep pets (not lessees or guests). Pets must be inoculated and registered with the association. Dogs must stay on a leash no longer than 6 feet outside the unit, and you must remove pet droppings immediately from common areas.
- Parking & vehicles: Park only in designated spaces. Temporary parking is allowed for visitors, delivery trucks, and service vehicles. Except for temporary parking, no buses, vans, or trucks over 3/4-ton capacity without Board approval. No vehicle repair or construction may be visible from the exterior, and inoperable vehicles cannot be stored visibly. The Board can tow violating vehicles at the owner's expense.
- Architectural review & exterior changes: Non-structural interior changes don't require approval, but any structural alteration requires Architectural Committee approval and certification from a licensed Arizona architect that it won't impair the building. Anything visible from outside—windows, satellite dishes, solar devices, balcony modifications, outdoor furniture—requires written Architectural Committee approval.
- Use restrictions: Units are for single-family residential use only; no commercial trade, profession, or occupation. You may keep a personal professional library and handle your own business calls and correspondence from your unit. No nuisances, exterior speakers, or offensive activity allowed. All state and local laws and zoning must be observed.
- Expansion & developer control: The developer may add up to 48 more units to the complex over the next 7 years without your approval. The developer currently controls the Board but will lose that control 90 days after 75% of units sell, or 4 years after they stop marketing units for sale, whichever comes first.
