What Sierra Prieta Estates's governing documents say
Sierra Prieta Estates is a single-family residential community in Phoenix, Arizona, where you own your individual lot and share responsibility for common areas (streets, landscaping, drainage, flood control) maintained by the homeowners association. The developer retains 51% voting control until the last lot sells or December 31, 2054, giving it veto power over major community decisions during that period.
- Ownership & common areas: You own your lot; the association maintains shared streets, landscaping, drainage, flood control, and open spaces, including city-assigned street-right-of-way landscaping. The city of Glendale assigned these responsibilities to the association.
- Assessments & fees: Annual assessments fund common-area maintenance. New owners pay a one-time working capital fee and reserve contribution (each equal to 1/6 of annual assessment) plus a transfer fee set by the board. Unoccupied lots pay 25% of occupied-lot rates. Assessments automatically increase 5% yearly unless the board votes otherwise; increases over 20% require 67% member vote.
- Developer voting control: The developer (Class B membership) holds 51% of all votes and can veto major changes until the last lot sells to a non-developer buyer or December 31, 2054. Regular owners (Class A) hold one vote per lot.
- Architectural review: All exterior improvements require Architectural Committee approval per design guidelines. Decisions must be delivered within 60 days; if not, your application is automatically approved. The board may charge a processing fee.
- Residential use & home businesses: All lots are for single-family residential use only. Home-based businesses are allowed if invisible from outside, involve no client visits or door-to-door solicitation, and don't disrupt the residential character or create excessive traffic.
- Pets: Reasonable numbers of domestic pets are allowed but must not make excessive noise, run at large, or relieve themselves on other's property or common areas. Pets must stay on your lot except when leashed (max 6 feet) under your direct control. No animal structures may be visible from neighboring properties.
- Guest occupancy: Guests or invitees may stay up to 30 days per calendar year (subject to board rules). Households can include up to 3 unrelated persons plus domestic servants.
- Late assessments & collection: Assessments due within 30 days. Late payments (15+ days overdue) incur a $15/month or 10% fee, whichever is greater. The association can record a lien, sue, or foreclose on delinquent accounts (subordinate to first mortgages).
