The golf course owner will make reasonable adjustments, but is not required to change settings that would cause inadequate irrigation of the golf course, as determined by the golf course owner.
- Liability & insurance for access road: The golf course owner must indemnify the association and declarant for any loss, cost, or liability arising from use of the access road by the golf course, its invitees, or licensees. The golf course owner must carry commercial general liability insurance of at least $2,000,000, naming the association and declarant as additional insureds, and provide an annual certificate.
- Golf course maintenance payments: The golf course owner pays the association a quarterly maintenance fee of $0.25 per 18-hole round of golf sold (with nine-hole rounds counting as half). A statement and payment are due 15 days after each quarter. The fee is capped at $15,000 per calendar year. The association may audit the golf course's records at its own cost; any shortage must be paid with 15% annual interest.
- Guard house staffing: If the golf course operates outside normal hours (5:30 a.m. to 6:00 p.m.), the golf course owner must reimburse the association for any additional costs to staff the guard house on McQueen Road. Payment is made monthly as determined by the association.
- Amendment authority for payment terms: Once the declarant no longer owns any lot, the board of directors and the golf course owner may jointly amend the payment terms (increases, decreases, or calculation methods) without lot owner approval, if they determine it is necessary in their reasonable business judgment.
- Golf course property expansion: A specific lot (Lot 1, Springfield Block Seven) is added to the Golf Course Property, meaning it becomes part of the golf course land governed by the declaration.
- What this document doesn't cover: This amendment does not address typical homeowner rules such as age restrictions, pet limits, leasing, architectural review, parking, or assessments on individual lots. Those would be in the original Declaration of Covenants.
