The association maintains common areas and enforces comprehensive design standards; initially, the developer retains enhanced voting control that converts to standard member voting over time.
- What you own & maintain: You own your lot and single-family dwelling outright. The association maintains five shared tracts, a pocket park, and certain right-of-ways, funded by per-lot assessments.
- Single-family dwelling & construction standards: Only one detached single-family home per lot. Lots 95–112 must exceed 2,000 sq ft; Lots 1–95 must exceed 1,500 sq ft; Lots 95, 96, 97 must be one story only. All homes must have tile roofs and block fencing with stucco coating (where visible from street).
- Architectural review & approval: All building plans, alterations, landscaping, and exterior changes must be approved by the Architectural Control Committee before construction begins. The Committee has final approval authority and may require detailed plans and specifications.
- Landscaping requirements: Full landscaping must be completed within 90 days of occupancy and maintained in harmony with the community. Front hedges cannot exceed 3 feet; rear and side fences cannot exceed 6 feet and must be masonry only (no chain link without approval).
- Vehicles & parking: All vehicles must be parked in a garage or approved enclosure, except working vehicles in daily use (passenger cars, vans, motorcycles, pickup trucks ≤3/4 ton). RVs, boats, trailers, and non-motorized vehicles are not allowed outside a garage. Driveway parking is limited to one week without written approval.
- Pets: A reasonable number of domestic house or yard pets are allowed (subject to local zoning). The Architectural Control Committee has final discretion on what constitutes a reasonable pet and whether a pet has become a nuisance. All pets must be leashed when outside fenced yards.
- Assessments & fees: Annual assessments begin at $300 per lot, increasing annually by the greater of the prior year's CPI increase or 5% (capped at 20% per year). Increases over 20% require a 2/3 member vote. Late payments accrue 12% annual interest. New owners pay a non-refundable working capital fund (1/6 of annual assessment) and a transfer fee (max $100).
- Developer control & voting transition: Lot owners vote 1 vote per lot (Class A membership). The developer (Class B) votes 9 votes per lot until Class A votes equal or exceed Class B votes, September 1 2006, or 5 years after the developer stops sales and construction activities—whichever comes first.
