This is a Tract Declaration for Stillwater Cove at Ocotillo, a single-family residential subdivision within the larger master-planned community of Ocotillo in Phoenix, AZ. It supplements the master Declaration (CC&Rs) and applies to homeowners and future owners in Stillwater Cove. Because it is a partial document, it does not contain the full set of community rules (e.g., pet policies, leasing restrictions, architectural standards for individual lots).
- Use & development restrictions: The Parcel (Stillwater Cove) must be used solely for single-family residential use as permitted by the master Declaration. No building permit or construction may commence without prior written approval of the Declarant (developer), including review of plans, landscaping, and easements.
- Subdivision & lot conveyance: The Parcel may not be further subdivided or any portion conveyed unless permitted by law and approved in writing by Declarant and the Association. Upon recordation of a final plat subdividing the Parcel into lots, obligations and liabilities apply proportionally to each lot.
- Inundation easement: All portions of the Parcel below 1,190 feet above mean sea level are subject to an inundation easement for water overflow from lakes or other sources. Neither Declarant nor the Association is liable for such overflow, and owners of low-lying lots must indemnify them for any damage from construction below that elevation.
- Maintenance responsibility: The Owner of the Parcel must maintain all common areas within the Parcel (or areas the Association controls) according to Association standards, unless the Association undertakes such maintenance.
