What Stone Butte's governing documents say
Stone Butte is a single-family residential community in Phoenix, AZ governed by an HOA with a Design Review Committee that controls the architectural character. All exterior modifications to your lot—including landscaping, fences, color schemes, and structures—require prior written approval, which can be denied on aesthetic grounds alone. The association maintains common areas and carries master insurance, funded by regular and special assessments levied per lot.
- Architectural approval: Any Construction or Modification of your lot requires prior written approval of the Design Review Committee, including new structures, landscaping, exterior paint, fences, and even antennas or satellite dishes. The committee has 45 days to respond; if no response is given, the application is deemed disapproved. The committee can deny applications based purely on aesthetic considerations and may charge a review fee.
- Residential use only: All residences must be used exclusively for residential purposes. A very limited home-based business is permitted only if it is not detectable from outside (by sight, sound, or smell), involves no customer visits, employs only residents of the property, and does not interfere with the residential character of the neighborhood.
- Maintenance & nuisances: You must keep your lot neat and free of rubbish, debris, odors, and loud noises. Outside clotheslines and other drying facilities are prohibited if visible from neighboring property. During construction, supplies and equipment must be stored in committee-approved areas, and temporary structures (trailers, tents) must be removed within 12 months.
- What the association maintains: The HOA maintains all common areas and carries master insurance on them. Owners are responsible for maintaining their own lots, including landscaping, and for boundary walls and certain other exterior features, with maintenance standards set by the Board.
- Specific restrictions: Mineral extraction is prohibited. American flags and certain military/state flags may be displayed, but other flags require approval. No buildings may be moved from elsewhere; all construction must be new. Antennas and satellite dishes require approval unless federal law prohibits such requirements.
- Assessments & reserves: Regular and Special Assessments are levied per lot to fund association operations, maintenance, insurance, and reserves. Non-payment creates an assessment lien on the property. Builders receive reduced assessment rates during the declarant control period.
- Design Review Committee control: During the declarant (D.R. Horton) control period, the declarant appoints and controls the Design Review Committee. After the declarant sells all its lots and exits, the Board of Directors appoints the committee. All decisions of the committee are final.
- What this document doesn't fully cover: This OCR'd excerpt omits detailed sections on vehicle and parking rules (section 4.13), rental restrictions for lots (section 4.19), specific landscaping requirements, and garage rules. Consult the full document and Design Guidelines for complete rules.
