Northwood Park Estates I is a single-family home subdivision in Cave Creek, Arizona, with a shared irrigation system owned and managed by a mandatory homeowners' association (Northwood Park Estates Unit One Property Owners' Association). The rules focus on maintaining the rural-residential character, including water rights from the Roosevelt Irrigation District, and apply to all lot owners automatically upon purchase.
- Use & residential requirements: Lots may be used only for residential or domestic farming purposes. Each lot is limited to one single-family detached residence with at least 1,200 square feet of living area (excluding garages, patios, etc.). No modular, manufactured, or moved homes are permitted; only new construction using conventional materials.
- Architectural review: All buildings, fences, and other structures require prior written approval by the Declarant (or successor) as to plans, materials, and location. The review body has absolute discretion, including on aesthetics. Failure to approve or disapprove within 30 days waives the requirement.
- Parking & vehicles: Camping trailers, RVs, boats, and similar vehicles may not be used as residences and must be parked on a hard-surfaced driveway or within an approved structure. They cannot be parked in the front yard except temporarily (up to 7 days). Inoperable vehicles must be stored in an enclosed garage.
- Animals: Per residence: no more than 4 adult dogs and 4 adult cats; no more than 2 exotic pets; no more than 3 large animals (horses, cattle, sheep, goats); no more than 10 poultry/fowl. No hogs or swine. Animals must be fenced or leashed. Barbed wire fences are prohibited; maximum fence height is 6 feet.
- Irrigation system & water rights: Each lot has a pro-rata undivided interest in the shared irrigation system. Water allotments are assigned to the Association, which orders and delivers water from the Roosevelt Irrigation District. Owners must pay assessments and water charges; default can result in loss of water rights and a lien on the lot.
- Enforcement & violations: Violating the Declaration is a nuisance. The Association may enter a lot to correct violations and charge the owner. Unpaid assessments accrue interest at 18% annually and can result in a lien foreclosable as a realty mortgage. Defaulting owners lose water rights until cured.
- Duration & amendment: The Declaration runs with the land until January 2, 2013, and automatically renews every 10 years unless 75% of lot owners vote to terminate or amend. Amendments require written consent of 75% of lot owners and must be recorded.
