What The Pinnacle at Desert Peak's governing documents say
This is the full Declaration of Condominium for The Pinnacle at Desert Peak in Phoenix, AZ—a condominium community where you own your individual unit (either a duplex or triplex unit) and share ownership of common elements. The community is part of a larger master-planned development with a Master Association (Desert Peak Homeowners Association). This document governs the rights and responsibilities of unit owners, including maintenance, leasing, use restrictions, and assessments.
- What you own & maintain: Units are either Duplex Units (side-by-side) or Triplex Units (three units sharing a garage structure). The unit includes the residential dwelling and yard, but not structural components, pipes, or utility lines serving multiple units (those are common elements). The Association maintains common elements, Front and Side Yards, and certain utility easements; unit owners maintain their interiors and private yards (for rear triplex units).
- Leasing & rentals: Unit owners may lease their unit, but the lease must be in writing and the lessee must comply with all covenants. No minimum lease term is specified in the provided text. The unit owner remains responsible for violations by tenants.
- Use restrictions & home businesses: Units are for residential use by a single family. Home businesses are allowed only if they are not visible or audible from outside, comply with zoning, do not increase traffic or parking, and do not use hazardous materials beyond residential quantities. The Association can restrict business activities in its sole discretion.
- Parking & vehicles: Each Triplex has a Garage Structure with designated parking spaces: one space per unit (front triplex unit has one; rear triplex units have one or two spaces depending on unit size). Spaces are for parking standard passenger vehicles and limited storage. Rear triplex unit owners have an easement to access their spaces via the front triplex unit's driveway.
- Assessments & fees: Common expenses are allocated equally among all units (each unit pays 1/total number of units). Special assessments may be levied. The Association can impose enforcement assessments and liens for nonpayment. A working capital fund and reserves are maintained.
- Architectural & maintenance control: Any modifications to the exterior, including garage structures and yards, require prior approval from the Architectural Committee or Board. Unit owners are responsible for interior maintenance; the Association maintains common elements and front/side yards. Party walls between adjoining units are shared maintenance.
- Easements & shared access: Numerous easements exist: for utility lines, ingress/egress over common elements, pedestrian access to rear triplex units, and structural support. The Declarant (builder) retains easements for development, sales, and construction activities until the condominium is complete.
- Proximity to airport, power lines & development: The condominium is within 3 miles of Deer Valley Airport and near high-tension power lines and undeveloped land. Owners assume all risks from noise, disturbances, and potential property damage; they indemnify the Association and Declarant.
