What Sun-Aer Estates's governing documents say
Sun-Aer Estates, Unit II is a condominium community established in 1973 in Maricopa County, Arizona. There are 334 apartment units on individual lots, with shared common areas and facilities. Unit owners automatically become members of the Sun-Aer Estates Unit II Association, which manages the property and collects assessments. This document defines ownership structure, use restrictions, and rules for the community.
- What you own & maintain: You own the interior surfaces of your apartment space (walls, floors, ceilings) and have an undivided 1/334 interest in the common areas. The association maintains common areas and carries master insurance. You must obtain your own fire and liability insurance for your unit.
- Leasing & rentals: Leases must be for at least 30 days (no transient or hotel use). You cannot rent if customary hotel services are provided. Leases must comply with the Declaration and Association bylaws.
- Party walls: Walls between units are party walls. If damaged by you or your guests, you must repair at your own cost. If damaged by other causes, repair costs are shared equally between adjoining owners. Alterations to party walls require written consent from the neighbor.
- Assessments & liens: The association levies assessments for common expenses. Unpaid assessments become a lien on your unit, superior to most other liens except tax liens and first mortgages. The association can foreclose and seek a receiver to collect rent. A new owner acquiring title through foreclosure is not liable for prior owner's unpaid assessments.
- Use restrictions: Units may only be used as private dwellings. No owner can exempt themselves from assessments by giving up use of common areas. All owners must comply with the Declaration, Articles, Bylaws, and Association decisions.
- What this document doesn't cover: This excerpt does not address pets, age restrictions, parking, architectural changes, or specific fee amounts. Those rules may exist in separate documents like the Association Bylaws or Declaration of Restrictions.
