As a property owner, you'll pay assessments to the association, must obtain Design Review Committee approval before any construction on your parcel, and may be required to construct or fund arterial streets and drainage improvements adjoining your property.
- Community structure & governance: The Superblock 3 Property Owners Association (the umbrella organization) maintains common areas, reviews designs, and coordinates subsidiary associations formed by individual parcel owners. The Master Developer (Northeast Phoenix Partners) retains approval rights over amendments, design guidelines, and certain uses through July 6, 2023, to ensure the development remains compatible with the broader Desert Ridge master plan.
- What you own & what the association maintains: You own your individual parcel. The association maintains common areas including wash corridors (for drainage), arterial common areas (landscaping, sidewalks, bicycle paths, perimeter walls), flood control areas, trails, entry monuments, and open space. The association is NOT responsible for maintaining portions of resort or golf course properties.
- Design review & architectural control: All plans and specifications for improvements on your parcel must be submitted to the Design Review Committee for approval against Design Guidelines before construction begins. The committee may require bonds or security to ensure completion, approve variances from guidelines, and may charge review fees. Material amendments to Design Guidelines (e.g., overall landscaping or streetscape changes) require Master Developer approval.
- Assessments & liens: The association levies annual assessments, special assessments, and maintenance assessments per parcel to fund operations and common area maintenance. These assessments create a lien on your property; the association may enforce collection of delinquent amounts and can collect interest and collection costs.
- Permitted uses & restrictions: Specific uses are permitted or prohibited depending on which parcel you own (Hospital Parcel, Parcel 1, or Parcel 2); some uses require consent from the Master Developer or Hospital Owner. All parcels face restrictions on height, subdivision, party walls, garbage, landscaping, construction activities, nuisances, and dust control. The hospital must contain a minimum of 125 beds if constructed.
- Your development obligations: If your parcel includes an arterial street right-of-way, you must dedicate it to the City. You are responsible for installing arterial common areas (landscaping, sidewalks) abutting or on your parcel, share median costs if applicable, and install wash corridor improvements required by the drainage plan—or deposit escrow funds if improvements can't be installed when you develop.
