The Enclave – Via Bella is a single-family residential planned community in Phoenix, AZ, where you own your individual lot and the association maintains common areas and enforces strict design and aesthetic standards through an Architectural Committee, funded by per-unit assessments. Nearly every visible change to your property requires advance approval.
- What you own & maintain: You own your individual lot and residence; the association maintains common areas, streets, medians, and easements, and carries master insurance funded by annual assessments levied per lot.
- Architectural review & approval: The Architectural Committee must approve any visible improvement before work begins—landscaping, fencing, driveways, exterior color, equipment, signs, or structural changes. All new construction requires a formal front-yard landscape plan. Approval is deemed granted if the committee doesn't respond within 60 days; changes to approved plans require new approval and fees.
- Minimum home size: Single-story homes must have at least 4,200 sq ft of main-floor liveable space. Two-story homes must have at least 3,800 sq ft on the main floor with a combined 4,200 sq ft minimum (main + upstairs).
- Privacy & windows: No residence, deck, balcony, platform, or camera may allow viewing into a neighbor's side or rear yard. Two-story homes cannot have windows, openings, or balconies overlooking a neighbor's property.
- Pets: You may keep a reasonable number of domestic pets (dogs, cats, parakeets, or similar household birds); two pets are allowed without board approval. Pets must be confined to your lot and leashed when off-lot; pet structures cannot be visible from neighboring property.
- Vehicles & parking: No commercial vehicles (with logos or equipment), RVs, mobile homes, trailers, or boats may be parked where visible from neighboring property. Temporary exceptions: guest vehicles for up to 12 consecutive hours on streets, or your RV/boat on your driveway for max 48 hours per 7-day period (loading/unloading only). The board may tow violating vehicles at the owner's expense.
- Residential use & home business: Lots are restricted to residential use. A home-based business is permitted only if it is not detectable from outside by sight, sound, or smell, involves no visitors or solicitation, complies with zoning, and does not create a nuisance.
- Leasing & rentals: You may lease your residence to a tenant, provided the lease requires the tenant to comply with all community restrictions and rules.
