This is a Declaration of Restrictions for Paradise Valley Oasis No. 7, a single-family residential subdivision in Phoenix, AZ. It sets enforceable rules that apply to all lot owners and their tenants, covering what you can build, how you can use your property, and design standards.
- Minimum home size & construction: Each dwelling must have at least 750 square feet of ground floor area (excluding garage, porch, or patio), be built of masonry, asbestos shingle siding, or similar, and be new construction—no moved buildings allowed. Only one residence per lot.
- Setbacks & building placement: Front walls (closest to street) must be 20 to 50 feet from the front property line. Open porches, carports, or balconies may project up to 5 feet into the front yard. Side walls must be at least 5 feet from side property lines (7.5 feet if the side line is on a street), except detached garages on the rear third of the lot may come within 2 feet. Maximum building height: two stories.
- Architectural approval & design review: No structure may be built or altered until its design, location, and materials are approved in writing by a committee (originally three named individuals, later replaced by a committee elected by lot owners). If the committee fails to act within 30 days of a request, approval is waived as long as the building complies with all other restrictions and is in harmony with existing nearby structures.
- Use restrictions & home businesses: All lots are for residential use only. No trade or business may be conducted on the premises, except that a builder may use a model home or sales office during development.
- Fences, walls & hedges: No solid wall or fence over 3.5 feet high may be built closer to the front street than the front wall of the house (or within 30 feet of the front lot line if no house yet). Side and rear fences or walls (not part of the house) may be up to 6 feet. No hedge over 3.5 feet may be planted within 20 feet of the front lot line.
- Sanitary facilities & utilities: All homes must have water-flush toilets and bathrooms connected to a concrete septic tank with a dry cesspool (until public sewer is available, then connections to sewer required). No building may be placed over or across utility or irrigation easements shown on the plat.
- Prohibited animals: No livestock of any kind may be kept on any lot.
- Duration & modification of restrictions: These covenants run with the land until January 1, 2002, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
