This is a set of covenants for Brentwood, a low-restriction rural subdivision designed for small farmsteads, cabin getaways, and peaceful rural living. The rules emphasize residential and recreational use, allow hunting, camping, mobile homes, and livestock, with minimal restrictions. These covenants are binding on all property owners and occupants.
- Permitted uses: All parcels are for single-family residential and recreational use only. No commercial activity (including greenhouses or commercial marijuana growing) is allowed. Livestock may be kept, but not in a commercial capacity. Ranching is permitted on fenced parcels.
- Dwelling & temporary structures: Only one single-family dwelling per five acres is permitted. Temporary structures like tents, lean-tos, or outbuildings cannot be used as residences but may be used for recreation no more than 21 days per year. Travel trailers, RVs, and portable cabins are allowed. Temporary shelter during home construction is allowed.
- Livestock & pets: Livestock and pets are allowed as long as they do not create a nuisance. No swine in a commercial capacity. Horses and cattle are allowed in reasonable numbers for personal consumption. No more than three dogs per contract for deed, and dogs must be confined to your property.
- Waste & derelict vehicles: Waste must be in closed containers. No dumping or burying of garbage, junk, oil, or liquids. Derelict vehicles (inoperable or unlicensed) must be kept in an enclosed garage. No junkyards or car stripping.
- Environmental protection: Trees with a trunk diameter of 6 inches or more (measured 2 feet above ground) may only be cut if dead/dying or for building sites, roads, utilities, fire prevention, view corridors, or open space. No more than 20% of any parcel may be cleared. No commercial timber harvesting, excavation, or selling of rock. No damming or rerouting of natural streams, and no foreign substances in waters.
- Roads & access: Road maintenance is the responsibility of individual owners. Commercial vehicles and heavy equipment may not use roads unless approved, and any damage must be repaired by the owner responsible. Delivery trucks are allowed. Hunting is prohibited on access roads.
- Setbacks & subdivision: No structures (except fencing and mailboxes) within 70 feet of any access road or 50 feet of property boundaries. Fences cannot encroach on road easements. No subdivision of parcels without written consent of the Seller.
- What this document doesn't cover: This document does not establish a homeowners association, board, or mandatory fees. It does not include rules about leasing, rentals, architectural review, parking (beyond derelict vehicles), or age restrictions. No provision for common areas or shared amenities beyond road maintenance.
