What The Haciendas at Vineyard's governing documents say
The Haciendas at Vineyard is a single-family home community in Phoenix, AZ. This Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs) creates a homeowners association (HOA) and sets the rules that all lot owners must follow. It covers everything from architectural controls and leasing limits to parking, trash, and maintenance obligations.
- Leasing & rentals: Leases must be in writing and for at least six months. Owners must provide the association with tenant information and a fee within 15 days of a new lease. The association may enforce these restrictions, including through eviction if allowed by law.
- Residential use & home businesses: All dwellings must be used as a single-family residence (maximum three unrelated persons). Home businesses are allowed only if not obvious from outside, limited to one employee (unless additional are residents), and do not generate excessive traffic or noise.
- Architectural review: Any exterior modification visible from neighboring property (e.g., painting, additions, landscaping changes) requires prior written approval from the architectural committee. The committee may deny based on aesthetics, and owners must submit plans. A fee may be charged for review.
- Parking & vehicles: Commercial and recreational vehicles are restricted (details in section 3.19). The association may tow vehicles that violate rules. All vehicles must be parked in accordance with further parking restrictions adopted by the board.
- Trash & recycling: Garbage and recyclables must be kept in covered containers and placed at the curb no more than 12 hours before or after collection. No incinerators are allowed. Repeated violations may result in fines.
- Clothes drying: No outside clotheslines or drying facilities may be placed on the public yard of a lot or where visible from neighboring property.
- Temporary structures: No trailers, tents, or temporary buildings may be used as a dwelling. Temporary structures for construction must be removed within 12 months unless the board approves otherwise.
- Enforcement & assessments: The association can levy annual and special assessments, create liens for nonpayment, and impose fines for violations. Owners are personally obligated for assessments, and the association has broad enforcement rights including legal action and towing.
