What The Oasis at Magic Ranch's governing documents say
The Oasis at Magic Ranch is a single-family home HOA in a master-planned community near a golf course and railroad tracks. These Covenants, Conditions & Restrictions (CC&Rs) apply to all lot owners, residents, and tenants. Living here requires following strict rules on property use, parking, pets, and architectural changes.
- Architectural review: All exterior construction, modifications, landscaping, and even repainting must be approved in writing by the Design Review Committee. Applications must include plans and fees; if no decision within 45 days, approval is deemed granted. Variances are possible but not guaranteed.
- Leasing & rentals: Leases must be written, for an initial term of at least one month, and cover the entire lot and residence. No subleasing or assignments allowed. Owners must provide copies of the CC&Rs and rules to tenants and notify the association 10 days before the lease starts. Owners remain liable for tenant violations.
- Vehicles & parking: Vehicles must be parked in the garage if space allows; otherwise in the driveway. On-street parking is prohibited if garage/driveway space is available. Recreational vehicles may be parked only for loading/unloading. No inoperable or commercial vehicles are allowed visible from neighboring property.
- Animals: Only reasonable numbers of domestic pets (dogs, cats, birds) allowed, with 'reasonable' determined by the Board. Dogs must be leashed (max 6 feet) when off the lot and cannot enter other lots. Owners must clean up feces on common areas. No structures for animals visible from neighboring property.
- Use restrictions: Lots are for residential use only. Businesses can be conducted inside the home only if not detectable from outside and meeting strict conditions. No signs visible from neighboring property without approval. No portable basketball goals; permanent ones need approval. Antennas/satellite dishes require approval unless prohibited by law.
- Maintenance & improvements: Owners are responsible for maintaining their lot, including landscaping, fences, and structures. The association maintains common areas. Landscaping must be installed within 90 days of lot purchase: at least one 15-gallon tree, five 5-gallon plants, ground cover, and underground irrigation in front yards.
- Common area access: All owners and residents have use of common areas, but the association may regulate use, suspend access for delinquent assessments (15+ days) or rule violations, and charge fees for recreational amenities. Leased lot tenants get use rights during the lease term.
- Disclosures (golf course & railroad): The property is near an active golf course and railroad tracks. Owners accept risks from golf balls, noise, odors, and train operations. The golf course is not part of the HOA and may change ownership or access. No claim may be made against the association or declarant for these conditions.
