Velvet Shadows is a single-family residential subdivision in Phoenix, AZ, governed by this Declaration of Restrictions. Each lot is intended for one single-family home, subject to architectural approval and various use restrictions. The document establishes an Architectural Control Committee and outlines rules to maintain a uniform, residential character.
- Architectural review: No structure may be built or placed without written approval from the Velvet Shadows Architectural Control Committee (initially officers of Western Futures, Inc.). After 75% of lots are sold, lot owners may elect a committee. Plans and materials must be approved; side and front setbacks of 25 ft and 50 ft apply.
- Land use & restrictions: All lots are for single-family residential use only. No business, lodging, or commercial activity is allowed, except artists may pursue their art on the premises without advertising or selling. No poultry, no burning of trash, and lots must not be maintained in a way that depreciates adjacent property.
- Structures & buildings: One guest house (max 3 rooms + bath + 2-car garage) per lot is allowed, must conform architecturally. No temporary buildings, trailers, or unsightly structures. All utility lines must be underground unless the committee permits overhead. Fences/walls cannot exceed 6 ft in height.
- Changes & amendments: Before Sept. 1, 1978, restrictions can only be changed with written consent from adjacent lot owners and committee approval. After that date, a majority of all lot owners (by recorded written consent) can amend. A violation does not affect existing mortgage liens.
- Enforcement: Any lot owner in Velvet Shadows may sue to enforce the restrictions, seeking an injunction or damages. Failure to enforce a violation does not waive the restriction for future breaches.
